NB: All owner of short term villas are legally obliged to collect the Climate Resilience Levy as a separate tax for all overnight stays per villa as follows€8.00 per night on stays between 01 March and 31 October and €4.00 per night on stays between 01 November and 28/29 February.

We will collect the Climate Levy with your final balance payment and it will be clearly itemised on your Booking Confirmation.

 Whilst we understand the potential budget concerns of our guests, this tax/levy is beyond our control and we encourage our guests to see this as a way of contributing to the protection of the planet and the beautiful area where they are holidaying.

All prices are reviewed at the beginning of each year and may be subject to change.

Agreement Terms & Conditions

 

Agreement, Terms & Conditions on the Short-term Rental of Villa Buoys, for Recreational Purposes. A copy of this document will be emailed to you with the booking confirmation, to be signed and returned.

 

I. Introductory Provisions
1. The Accommodation Provider (Crete Villa Holidays) is the proprietor of the short-term rental property: Villa Agória
in the cadastral territory of the local district of Plaka, Apokoranas 73008, Crete, Greece.

2. The Guest booking the villa declares that he/she has read and understood the publicly available information on the Accommodation Provider’s website at http://www.cretevillaholidays.org about the Recreational Facility, about Villa Agória, and other published information, particularly the booking system, the Accommodation Rules and General Business Terms and Conditions (GBTC) before signing this Agreement, and has clarified any uncertain points with the Accommodation Provider before making the booking and signing this Agreement and, after careful consideration, is interested in using the Recreational Facility including its parts and accessories in the villa for temporary accommodation and recreational purposes.

 

II. Subject matter of Accommodation

1. The Accommodation Provider (Crete Villa Holidays) provides the Recreational Facility to the Guests, under the terms specified by this Agreement for temporary accommodation for recreational purposes and the Guests undertakes to pay the Accommodation Provider the agreed price for the accommodation and the services associated with the accommodation in accordance with the terms specified below in this Agreement.

 

Description of Villa:

Villa Agória is on one level, with 2 double bedrooms and plenty of cupboard space in each room. It has a living room, small kitchen, 1 bathroom with shower, WC, sink and vanity unit. The lounge opens onto a courtyard with table and chairs for alfresco dining. Courtyard leads to a small garden area that has a plunge pool 1.2 metres deep. The garden has sunbeds and a cantilevered parasol.  

There is a roof terrace with panaoramic views to Souda Bay and Akrotiri. The roof terrace has an L shaped sofa, a pergola that is screened from two sides for privacy and a covered roof for shade.

The villa is fully furnished. There is a bluetooth speaker and wifi connection.

The lounge leads two steps up the bedrooms and bathroom. One bedroom has a bed with a double mattress. The doors open to the courtyard. The other bedroom has two single beds with single mattresses. The doors open onto the garden. All bedding and towels are provided.

There is air conditioning in the bedrooms and the lounge.

The kitchen is fully equipped with a ceramic hob, a cafetiere, fitted electric oven, dishwasher, fridge/freezer, kettle, microwave, toaster, kitchen utensils (pots and pans) and china (soup and dinner plates, coffee/tea mugs, glasses, salad bowls) and cutlery, wine

glasses, water glasses, etc.

The villa has a hair dryer.

The accommodation also has a washing machine situated in the bathroom.

 

2.The maximum number of Guests in the villa is 4. (This villa is not suitable for babies or children under the age of 1). The Villa, including the plunge pool, are intended for the Guests only, and not persons invited thereby or persons to whom they have given access (visitors). A breach of this duty is considered a gross violation of this Agreement.

Together with the Recreational Facility the Guests will also be entitled to use the car parking space at the front of the villa for 1 car, the outdoor barbecue, which is part of the Recreational Facility, the private outdoor plunge pool with sun loungers, parasol, courtyard, garden and roof terrace.

The rules for the use of the plunge pool and the garden, including safety rules, are part of the Accommodation Rules. All children must be supervised at all times around the plunge pool. There is to be no urinating in the plunge pool.

The plunge pool will be attended by a maintenance company twice a week whilst Guests are staying.

From time to time the Greek government will rule that no bbq’s are to be lit. This is to prevent any danger of fires during a very dry summer. The Accommodation Provider will not be held responsible if the Greek government passing this ruling and no compensation or refund will be issued to the Guests.

 

III. Purpose of Accommodation

1.The Recreational Facility is rented to the Guests for temporary family recreational purposes reserved for the Guests (Booking). Upon making the booking the Guests agrees to the temporary use of the Villa and Recreational Facilities and the Terms and Conditions set out herewith on the Crete Villa Holidays website.

 

IV. Accommodation period, Check-in and Check Out from the Villa and Recreational Facility

1.The Villa and Recreational facility will be kept ready for the arrival of the Guests and will be available to the Guests solely for the dates booked. The Villa key will be available in the key safe box. The location of the key safe box and the code will be provided to you prior to your departure to the Villa.

The Accommodation Provider reserves the right to make changes to the Villa prior to the Check In.

2. The Guests is obliged to check in the Villa and Recreational Facility on the first day of the booking and to vacate the Villa on the last day of the accommodation according to the booked dates and return the Villa key into the key safe box and left securely.

The final cleaning and washing of bedding and towels are done by the Accommodation Provider. If the Villa is found to be excessively dirty (i.e. more dirty than may be expected from normal use) the Guests is obliged to pay a flat-rate cleaning

fee of EUR 150. This flat-rate cleaning fee may be paid out of the security deposit paid in accordance with Art. V. of this Agreement.

The security deposit can also be used for damaged common areas, the cleaning of a bbq grill left dirty, the pool left dirty or damaging the garden around the villa. The Guests will be fined EUR 50 for each individual scenario.

In the instance that the villa keys are lost, the locks must be changed and new keys cut, this will need to be paid in cash by the Guests, immediately after the work is carried out.

3. The Accommodation Provider is entitled to cancel the booking or withdraw from this Agreement if the Guests fails to pay the agreed price pursuant to Article V of this Agreement. The Accommodation Provider has the right to the extraordinary cancellation of the booking or withdrawal from the Agreement for an objectively justified reason, i.e. if the performance of the Agreement is impossible due to force majeure or other circumstances, in particular, unforeseeable and extraordinary circumstances outside the Accommodation Provider’s control. If the Accommodation

Provider justifiably withdraws from the Agreement; the Guests will not be entitled to compensation.

4. The Accommodation Provider is entitled to withdraw from this Agreement without any notice, in which case the Guests is obliged to vacate the Recreational Facility and return it to the Accommodation Provider in the event of one of the gross breaches of this Agreement listed below:

i. Despite having been warned, the Guests grossly breaches any of its obligations

under this Agreement, particularly if they allow the use of the Villa and recreational Facilities, including the Swimming

Pool, by third parties, or they damage items in the Recreational Facility or property at the Villa.

ii. Despite having been warned, the Guests commits a gross breach of good morals.

iii. the number of people Checking-in to the Villa and Recreational Facility exceeds the maximum number of persons set out in this Agreement and no agreement on compensation has been

reached between the contracting parties.

5. The Guests is aware that it may not withdraw from this Agreement before the agreed

period. If it does so, and if the Accommodation Provider is able to prove that it incurred unavoidable

damage as a result, the Accommodation Provider has the right to request that Guests

pay it compensation for such damage.

 

V. Price of Accommodation, Maturity, Security Deposit

1. Price

The contracting parties agree that the price for the use of the Recreational Facility is in Euro (€) and according to the prices stated on the Crete Villa Holidays website. Bookings are only undertaken for a minimum of 7 days stay and no less.

It is the obligation of the Guests to make themselves aware of the Climate Levy Fee which the Accommodation Provider is obliged to collect by the government.

The booking will only be confirmed once the deposit is paid. These will be on a first come first serve basis.

The agreed price includes the use of the Recreational Facilities, including water consumption, use of WIFI and air conditioning, use of the pool including towels and bath towels, bed linen; bed linen, towels and bath towels are provided for the entire stay (7 nights) which are not changed. This does not apply to renting for more than a week, in this case the Accommodation Provider will clean the Villa and change bed linen and towels after 7 days. The price

also includes the use of barbecue, washing machine, final cleaning of the Villa (daily cleaning or cleaning at other intervals is not carried out). The pool will be cleaned twice a week during the Guests stay. The agreed price also includes electricity consumption.

The Guests acknowledges that in the summer, to reduce the temperature in the room, when leaving the building they should turn off all electrical equipment including air conditioning. Internal and external doors and windows must not be left open whilst the air conditioning systems are being used.

 

2. Maturity of price and security deposit

a) After receiving the booking confirmation an advance payment

amounting to 40 % of the total rental fee must be paid within 3 days

A Stripe booking link will be sent via email by the Accommodation Provider along with the Booking Confirmation. Payment will be in Euro. All bank charges related to bank payments to the Accommodation Provider’s account will be paid by the Guests.

b) The balance of the price is payable no later than within 30 days before the agreed Check In date.

c) The price is payable in full when booking/signing the Agreement less than 30 days in advance.

d) The price is considered paid when the entire sum as specified in paragraph 1 of this Article is credited to the bank account specified above.

e) If there is a delay of more than 4 working days in the payment of the price (advance payment, balance), the Accommodation Provider is entitled to terminate the booking and withdraw from this

Agreement.

g) Together with the balance of the price, a security deposit in the amount of 400 EUR must also be paid, by bank transfer to the account held with Alpha Bank, which is the same account as

for the booking. The security deposit cannot be paid or refunded by credit card.

h) Together with the balance of the price, a climate levy fee of €8 per night must also be paid, by bank transfer to the account held with Alpha Bank, which is the same account as for the booking. This is a Greek Government policy which every property owner is obliged to collect on the Government’s behalf.

The security deposit will be used to cover the legitimate monetary claims of the Accommodation Provider, particularly in the event of any damage to the Accommodation Provider’s property, damage

to items in the Villa and the Resort, debts, etc.

After any of the Accommodation Provider’s claims have been deducted the reminder of the security deposit will be returned to the Guests no later than within 5 days of the Check Out date and the return of the Villa to the Accommodation Provider – to the account from which the security deposit was paid, or to an account specified by the Guests in writing to the Accommodation Provider by

email at chat@cretevillaholidays.org

In the event of no claims by the Accommodation Provider, the security deposit of 400 EUR will be returned in full to the account from which the security deposit was paid.

h) Together with the balance of the price, the climate levy amount  must also be paid, by bank transfer to the account held with Alpha Bank, which is the same account as for the booking. This is a policy set by the Greek Government which all property owners are obliged to collect on their behalf.

 

 3. Change to Booking terms

All changes to bookings (changes to names, changes to the Villa, booking date, etc.) must be made in writing by sending an email specifying the required change to chat@cretevillaholidays.org  

Each change will subsequently be confirmed, if that change can be made. If a change cannot be made, the Guests will be informed in writing (by email) by the Accommodation Provider. The confirmed change will become part of the Agreement as an Amendment hereto.

 

4. Cancellation of a Booking, cancellation fees

The Guests have the right to cancel the order/booking and terminate this Agreement at any time prior to the Check-In. The order/booking can only be cancelled in writing, exclusively by the person who submitted it and from the same email from which it was made. To determine the amount of the cancellation fee, the date of delivery of the request sent to the Accommodation Provider by the Guests by e-mail shall be decisive. Unless agreed otherwise by the contracting

parties in writing, the Guests will be charged the following cancellation fees in the event of the cancellation of an order/booking:

If the Booking is cancelled within 14 days of signing the Agreement and payment of deposit, a 100% refund will be made.

If the Booking is cancelled after 14 days of signing the Agreement and payment of deposit, the cancellation fee is 30% of the rental price.

If the Booking is cancelled with 30 days of the date of arrival, the cancellation fee is 100% of the rental price.

When leaving earlier or later than the dates specified in this Agreement, the Guests are not entitled to any refund on the Price paid or its part.

VI. Further Rights and Obligations of the Parties

1. The Accommodation Provider is responsible for the provision of the ordered services and their quality and for the veracity of information about the rental of the villa. The Guests have the right to make any complaints without undue delay, but only during their stay. A record of the complaint must be drawn up between the Accommodation Provider and the Guests at the moment of the complaint being lodged. In case of a breach of obligations under this Agreement, the binding General Terms and Conditions or the Accommodation Rules – e.g. by providing false information in the

order (about a number of persons, pets), the Accommodation Provider may require financial compensation on the spot, or the Accommodation Provider is entitled to immediately terminate the

contractual relationship and expel all the guests staying at the Villa, if an agreement on compensation is not reached. The Accommodation Provider is entitled to proceed similarly in case of a repeat or gross breach of obligations stipulated by generally binding legal regulations (e.g. damage of property, gross breach of peace at night, etc.)

2. The Accommodation Provider is not liable for any damage or theft of items and personal belongings of persons during their stay in the villa. The Accommodation Provider bears no liability for injury or

other harm to persons using the villa. The stay and movement of persons throughout the whole property, on all premises and on land connected therewith is at the sole risk of the Accommodation

User and all persons staying therewith.

3. The Guests are under no circumstances, permitted to bring pets to the villa.

4. The Guests will not request that the Accommodation Provider will take custody of cash, jewellery or other valuables.

5. The Accommodation Provider will provide the Guests with the Recreational Facility in a condition fit for proper use and will enable the Guests to fully exercise its rights associated with the accommodation.

6. The Guests must use the Recreational Facility and the services relating to the accommodation in a due and proper manner; the Guests may not make any substantial

changes to the Recreational Facility without the consent of the Accommodation Provider. Smoking is prohibited inside the Villa and on the roof terrace. Smoking is permitted outside on the ground floor terrace area only.

7. The Guests are obliged to comply with the Accommodation Rules herein.

8. The Guests are obliged to comply with the Health and Safety Rules and Fire Rules, which form part of the Accommodation Rules herein.

9. The Accommodation Provider is obliged to comply with the General Terms and Conditions as set out herein.

VII. Final Provisions

1. The rights and obligations of the contracting parties not covered by this Agreement are governed by the relevant provisions of Act No. 89/2012 Coll., Civil Code.

2. This Agreement may only be amended as written numbered addenda signed by both the contracting parties.

3. If, at any time after this Agreement has been signed, it becomes apparent that any of its provisions are invalid, ineffective or unenforceable, the contracting parties undertake to promptly replace such provisions with new provisions that most closely approximate the economic intent of the original provisions, worded to ensure that they are valid, effective and enforceable.

4. This Agreement has been drawn up in two copies, of which each party receives one copy.

5. This Agreement becomes valid and effective on the date it is signed by the last contracting party.

6. The contracting parties jointly declare that this Agreement has been concluded as an expression of their true and free will, in proof of which they attach their signatures.
